1. Terms of Use

These Terms are a binding legal agreement between the User (You) and BML Group Ltd., registration number, C34836 of Experience Centre Ta’ Xbiex Sea Front Ta’ Xbiex (the Company).

By ticking “I accept these terms and conditions”, You agree that You have read, understood and accepted these Terms.

By submitting Your Information on the Site, You will accept that Your personal information will be stored in accordance with the Privacy Policy and agree that You have read, understood and accepted these Terms.

These Terms are deemed accepted by You each time that You use or access the Site, as amended from time to time.

If You do not accept the Terms stated here, kindly do not use the Site.

If You violate these Terms Your access and use of Site may be suspended or terminated, this is at the Company’s discretion.

You must be 18 years of age or older to visit or use the Site in any manner, and, if under the age of 18 or the age of majority as that is defined in Your jurisdiction, You must use this Site under the supervision of a parent, legal guardian, or any other responsible adult.

Access to the Content may not be legal by certain persons or in certain countries. If You access the Site You do so at Your own risk and are solely responsible for compliance with the laws of Your jurisdiction.

2. Definitions

You will see the following terms used throughout these Terms:

 “Company” the Site is run by BML Group Limited, a company registered in Malta, registration number C34836.  The registered office is at Experience Centre, Ta’ Xbiex Seafront, Ta’ Xbiex, XBX1027, Malta.

“Content” is the Content found on the Site, including but not limited to job postings.

“Information” means the information You submit and enter on Your Profile.

“Post” means information that You submit, publish or display on the Site.

“Privacy Policy” means the Site’s Privacy Policy as published on the Site from time to time.

“Profile” means the Profile created by You containing Your personal information. The Company may also collect information about You from publicly-available websites and may use this information to create a Profile or append it to an already existing Profile.

“Terms” are these terms, conditions and rules which you agree to when using the Site.

“Site” www.betssongroup.com.

“User/ You” is the User using the Site. “Users/Your” can be construed accordingly.

3. Use of the Site

3.1   When You register with the Site, You will be asked to create an account/make a profile and provide the Company with certain personal information.

3.2   Any Profile You submit must be true, accurate, up-to-date and describe You, an individual person. The Profile requires standard fields to be completed these include, name, surname, country, telephone numbers, valid email address. You are also responsible for ensuring that all information, data and files are free of viruses or other routines or engines that may damage or interfere with any system or data prior to being submitted to the Site.

3.3   You acknowledge and agree that You are solely responsible for the form, content and accuracy of any CV or material contained therein placed by You on the Site.

3.4   You understand and acknowledge that You have no ownership rights on Your account and that if You cancel Your account or Your account is terminated, all Your account information, including but not limited to, CVs, Profiles, covering letters, saved jobs will be marked as deleted in and may be deleted from the Company's databases. Information may continue to be available for some period of time because of delays in propagating such deletion through the Company’s web servers. In addition, third parties may retain saved copies of Your Information.

3.5   The Company reserves the right to delete Your account and all of Your Information after a significant duration of inactivity.

3.6   The Site may only be used for lawful purposes by individuals seeking employment. Your use of the Site is subject to these Terms. Furthermore all Users warrant and agree not to:

     a)   transfer, post, distribute, store or destroy material, including without limitation to Site content in violation of any applicable law or regulation, or in breach of the Site’s privacy policy;

     b)   use any data mining, robots or similar data gathering or extraction methods;

     c)   violate or attempt to violate the security of the Site including attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;

     d)   collect, copy or duplicate in any manner any of the Site’s Content or information available from the Site, including expired job postings, other than as permitted by these Terms;

     e)   post any CV or Profile, or apply for any job on behalf of another party;

     f)   apply more than once for the same job posting;

     g)   share with a third party any login credentials to the Site;

     h)   access data not intended for You or logging into a server or account which You are not authorized to access;

     i)   post or submit to the Site any incomplete, false or inaccurate biographical information or information which is not Your own;

     j)   post content that contains restricted or password-only access pages, or hidden pages or images;

     k)   solicit passwords or personally identifiable information from other Users;

     l)   delete or alter any material posted by any other person or entity;

     m)   harass, incite harassment or advocate harassment of any group, company, or individual;

     n)   attempt to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to any Site, overloading, “flooding”, “spamming”, “mail-bombing” or “crashing”;

     o)   promote or endorse an illegal or unauthorized copy of another person's copyrighted work, such by as providing or making available pirated computer programs or links to them, providing or making available information to circumvent manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files;

     p)   use the services for any unlawful purpose or any illegal activity, or post or submit any content, CV, that is defamatory, libellous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory, of a menacing character or likely to cause annoyance, inconvenience, embarrassment, anxiety or could cause harassment to any person or include any links to pornographic, indecent or sexually explicit material of any kind, as determined by Company’s discretion; or

     q)   post any CV which is not a genuine CV and which attempts to advertise or promote products or services.

4. Liability

The Site, acts as a venue for candidates to apply for a role with the Company or with an affiliated company of the Company (for example a member company of the same group of companies) by creating Profiles and uploading their CV. While the Company reserves the right in its sole discretion to remove job postings or other material from the Site from time to time, the Company does not assume any obligation to do so and to the fullest extent permitted by law, disclaims any liability for failing to take any such action.

The Site and the Content may contain inaccuracies or typographical errors. The Company makes no representations about the accuracy, reliability, completeness, or timeliness of the Site or the Content. The use of the Site and the Content is at Your own risk. Changes are periodically made to the Site and may be made at any time.

Whilst the Company tries to ensure that the standard of the Site remains high and to maintain the continuity of it, the internet is not an inherently stable medium, and errors, omissions, interruptions of service and delays may occur at any time. The Company does not accept any liability arising from any such errors, omissions, interruptions or delays or any ongoing obligation or responsibility to operate the Site (or any particular part of it) or to provide the service offered on the Site. The Company may vary the specification of this Site from time to time without notice.

On this site you will be offered automatic links to other sites. The Company does not accept any responsibility for or liability in respect of the content of those sites, the owners of which do not necessarily have any connection, commercial or otherwise, with us. Using automatic links to gain access to such sites is entirely at your own risk.

5. Disclaimer of Warranty.

To the fullest extent possible by law, the Company does not warrant that the Site or the Content will operate error free or that the Site and its servers are free of computer viruses or other harmful mechanisms. If Your use of the Site or the Content results in any cost, the Company is not responsible for such costs.  The Site and the Content are provided ‘as is’ without any warranties of any kind. The Company, to the fullest extent permitted by law, disclaims all warranties, whether expressed or implied, Furthermore, the Company makes no warranties about the accuracy, completeness of the Content, services, software, text, graphics and links.

6. Indemnity.

You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal fees, alleging or resulting from:

     (i) any personal information or other material You provide to the Site,

     (ii) Your use of any the Content, or

     (iii) Your breach of these Terms.

7. Data Protection

In the course of providing this Site to the You the Company may occasionally process Your personal data, this is done only to the extent, and in such a manner, as is necessary for the purposes specified in this Agreement and shall not process the personal data for any other purpose. The Company shall ensure that access to such personal data is limited to those employees who need access to such data to meet the Company’s obligations under this Agreement. The Company will keep a record of any processing of personal data it carries out on Your behalf. The Company may transfer the personal data outside the European Economic Area without Your prior consent.

The Company undertakes to process personal data in accordance with the Data Protection Act (Chap. 440 of the laws of Malta).

8. Term and Termination.

These Terms will remain in full force and effect while You are a User of the Site. The Company reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to removal of all Your personal information, CVs etc. from the Site and immediate delete Your Profile with or without the ability to access the Site, upon any breach by You of these Terms or if the Company is unable to verify or authenticate any information You submit to the Site upon registration. Even after You are no longer a User of the Site, certain provisions of these Terms will remain in effect, including 1, 3 through 7 inclusive and 9 through 13 inclusive.

9. Intellectual property

9.1   The Company is the owner or the rightful licensee of the rights to the technology, software and business systems used within the Site.

9.2   The contents and structure of the Site pages are subject to copyright © and database rights in the name of BML Group Limited. All rights reserved. The copyright in this Site including all text, graphics, code, files and links belongs to us and the Site may not be reproduced, transmitted or stored in whole or in part without our written consent. Your registration and use of the Site does not confer any rights whatsoever to the intellectual property contained in the Site.

9.3   You agree not to use any automatic or manual device to monitor our web pages or any content therein. Any unauthorised use or reproduction may be prosecuted.

10. Severability

If any provision of these Terms is held to be illegal or unenforceable, such provision shall be severed from these Terms and all other provisions shall remain in force unaffected by such severance.                            

11. Entire Agreement and Admissibility

11.1  The Terms are the entire Agreement between us with respect to this Site and, overrule all prior communication and proposals, whether electronic, oral or written, between us.

 

11.2  A printed version of these Terms and any notice given in electronic form shall be admissible in judicial or administrative proceedings. 

12. Assignment

The Company can assign or transfer this Agreement. You cannot assign or transfer this Agreement.

13. Applicable law, jurisdiction and language

13.1  These Terms are governed by the Laws of Malta and the both You and the Company agree to be subject to the jurisdiction of the Maltese courts and/or to the rules of arbitration in accordance with Malta’s Arbitration Act as administered by Malta’s Arbitration Centre.
